1. Introduction

Purpose of the Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of the Digital Legal Document Generation Platform (“Platform”), known as Dokumente Ligjore, implemented by PEN and supported by USAID Justice Activity. The purpose of these Terms is to outline the rules and guidelines for using the Platform, ensuring a secure, efficient, and lawful use of our services.

Acceptance of Terms

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you must refrain from using the Platform. Your continued use of the Platform constitutes your acceptance of any updates or modifications to these Terms.

2. Definitions

Platform: Refers to the Digital Legal Document Generation Platform, known as Dokumente Ligjore, implemented by PEN and supported by USAID Justice Activity.

User: Any individual or entity that accesses or uses the Platform.

Services: The services provided by the Platform, including but not limited to, the provision of free legal document templates for informational purposes.

Content: All materials, including text, graphics, templates, and other resources available on the Platform.

Account: A registered profile created by a User to access certain features of the Platform.

Personal Information: Any information that identifies or can be used to identify a User, collected through the Platform.

Third-Party Links: External websites or resources linked to from the Platform, not owned or controlled by the Platform.

3. Use of the Platform

Description of Services Provided: The Platform provides Users with access to a variety of free legal document templates across different legal fields, including commercial, administrative, civil, and criminal. These templates are intended for informational purposes and to assist Users in preparing legal documents. The Platform does not offer legal advice, and Users are encouraged to consult with a qualified legal professional for specific legal needs.

User Eligibility: To use the Platform, Users must be at least 18 years old or have the legal capacity to enter into binding agreements under applicable law. By using the Platform, Users represent and warrant that they meet these eligibility requirements.

User Account Creation and Responsibilities: Users may be required to create an account to access certain features of the Platform. During the registration process, Users must provide accurate and complete information. Users are responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account. The Platform reserves the right to suspend or terminate accounts for any unauthorized use or violation of these Terms.

4. User Obligations

Accurate Information Provision

Users agree to provide accurate, current, and complete information when using the Platform and to update such information as necessary to ensure it remains accurate and complete.

Compliance with Applicable Laws

Users must comply with all applicable laws and regulations when using the Platform. This includes, but is not limited to, laws related to intellectual property, data protection, and privacy.

Prohibited Activities

Users must not engage in any activities that:

  • Violate any applicable laws or regulations.
  • Infringe on the intellectual property rights or other rights of third parties.
  • Include unauthorized access to, interference with, damage to, or disruption of the Platform or its systems.
  • Involve the transmission of any harmful, offensive, or illegal content.
  • Attempt to gain unauthorized access to other user accounts or the Platform’s systems or networks.

By adhering to these obligations, Users help ensure a secure and respectful environment for all who utilize the Platform.

5. Intellectual Property

Ownership of Content

All content available on the Platform, including but not limited to text, graphics, templates, and other resources (“Content”), is the property of Dokumente Ligjore, PEN, or their respective content suppliers. This Content is protected by intellectual property laws, including copyright, trademark, and other proprietary rights.

Limited License to Users

Dokumente Ligjore grants Users a limited, non-exclusive, non-transferable license to access and use the Content for personal, non-commercial purposes only. This license does not allow Users to download, modify, distribute, or create derivative works based on the Content, except as explicitly permitted by these Terms or with prior written consent from Dokumente Ligjore.

Restrictions on Use

Users must not:

  • Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Content or the Platform without express written permission from Dokumente Ligjore.
  • Use the Content or the Platform for any unauthorized or illegal purposes.
  • Remove or alter any copyright, trademark, or other proprietary notices from the Content.

Users acknowledge and agree that Dokumente Ligjore may collect and process their personal information for the purposes of providing and improving the Platform’s services, communicating with Users, and complying with legal obligations.

Inclusion of any links to third-party websites or services does not imply endorsement or approval by Dokumente Ligjore. Users acknowledge and agree that Dokumente Ligjore is not responsible or liable for any content, products, services, or other materials available from such third-party websites or services. Users access and use third-party websites or services at their own risk.

8. Disclaimers and Limitation of Liability

Platform Provided "As Is"

The Platform and all Content are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied. Dokumente Ligjore disclaims all warranties, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

No Warranties

Dokumente Ligjore does not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. Dokumente Ligjore does not make any warranties or representations regarding the accuracy, reliability, or completeness of any Content provided through the Platform.

Limitation of Liability for Damages

To the fullest extent permitted by law, Dokumente Ligjore shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to Users’ use of or inability to use the Platform or any Content, even if Dokumente Ligjore has been advised of the possibility of such damages. This limitation of liability applies to all causes of action, whether based on contract, tort, negligence, strict liability, or any other legal theory.

9. Indemnification

User Agreement to Indemnify the Platform

Users agree to indemnify, defend, and hold harmless Dokumente Ligjore, PEN, USAID Justice Activity, and their respective officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that arise from or relate to:

  • Users’ use or misuse of the Platform or Content.
  • Users’ violation of these Terms.
  • Users’ violation of any rights of a third party, including intellectual property rights.
  • Users’ violation of any applicable laws, regulations, or rules.

Scope of Indemnification

The obligation to indemnify includes, without limitation, claims arising out of the infringement of intellectual property rights, defamation, invasion of privacy, and any other legal or equitable claims. This indemnification obligation will survive the termination or expiration of these Terms and Users’ use of the Platform.

10. Modification of Terms

Right to Modify Terms

Dokumente Ligjore reserves the right, at its sole discretion, to modify, amend, or replace these Terms at any time. Any changes will be effective immediately upon posting the updated Terms on the Platform.

Notification of Changes

Users will be notified of any material changes to these Terms through a prominent notice on the Platform or by other reasonable means. It is Users’ responsibility to review the Terms periodically to be aware of any changes.

User Acceptance of Modified Terms

By continuing to access or use the Platform after any changes to these Terms have been posted, Users agree to be bound by the revised Terms. If Users do not agree to the new Terms, they must stop using the Platform.

11. Mbyllja

Arsyet për Mbyllje

Dokumente Ligjore rezervon të drejtën për të pezulluar ose mbyllur aksesin e një Përdoruesi në Platformë në çdo moment, pa njoftim paraprak ose përgjegjësi, për çdo arsye, duke përfshirë por pa u kufizuar në:

  • Shkelja e këtyre Kushteve.
  • Shkelja e ligjeve ose rregullave të zbatueshme.
  • Sjellja që Dokumente Ligjore përcakton, sipas diskrecionit të saj të vetëm, si të dëmshme për Përdoruesit e tjerë, Platformën, ose interesat e Dokumente Ligjore.

Pasojat e Mbylljes

Pas mbylljes së aksesit të një Përdoruesi në Platformë:

  • E drejta e Përdoruesit për të përdorur Platformën do të ndalojë menjëherë.
  • Të gjitha dispozitat e këtyre Kushteve që natyrshëm duhet të mbijetojnë pas mbylljes do të mbijetojnë, duke përfshirë, pa kufizim, dispozitat e pronësisë, heqjet e garancive, kompensimin, dhe kufizimet e përgjegjësisë.
  • Përdoruesi nuk do të ketë të drejtë për ndonjë rimbursim ose kompensim për pasojat e lidhura me mbylljen.

12. Governing Law and Dispute Resolution

Applicable Law

These Terms are governed by and construed in accordance with the laws of Kosovo, without regard to its conflict of law principles.

Jurisdiction

Users agree that any legal action or proceeding arising out of or relating to these Terms or the User's use of the Platform will be brought exclusively in the courts of Kosovo. Users consent to the personal jurisdiction and venue in these courts and waive any objection to such jurisdiction or venue.

Dispute Resolution Process

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the User's use of the Platform, the parties agree to attempt to resolve the matter through good faith negotiations. If the dispute cannot be resolved through negotiations, it shall be submitted to mediation or arbitration in Kosovo, in accordance with applicable Kosovar laws and procedures.

13. Miscellaneous

Entire Agreement

These Terms constitute the entire agreement between the User and Dokumente Ligjore regarding the use of the Platform and supersede any prior agreements or understandings, whether written or oral, relating to such subject matter.

Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, such provision will be severed from the Terms, and the remaining provisions will remain in full force and effect.

Waiver

No waiver of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

Assignment

Users may not assign or transfer their rights or obligations under these Terms without the prior written consent of Dokumente Ligjore. Dokumente Ligjore may assign or transfer its rights and obligations under these Terms without restriction.
